  1. Scope
    These General Terms and Conditions (GTC) apply to all deliveries from Pauseback Media (sole proprietorship) to consumers. A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed.
  2. Contracting Party
    The purchase contract is concluded with Pauseback Media (sole proprietorship), owner: Nikolaus Pauseback, Moltkestr 79, 50674 Cologne, VAT identification number: DE328948306
  3. Conclusion of contract
    1. The presentation of the products on the website and in the online shop (at Amazon) does not constitute a legally binding offer, but only an invitation to order.
    2. By clicking the [Buy/order with costs] button, you place a binding order with Amazon for the goods listed on the order page. Your purchase contract is concluded when we accept your order with an order confirmation email immediately after receipt of your order.
  4. Right of Withdrawal
    1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with the statutory provisions.
    2. If you, as a consumer, make use of your right of withdrawal according to Section 4.1, you have to bear the regular costs of the return

      You have the right to withdraw from this contract within fourteen days without giving any reason.
      The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

      by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. If you make use of this option, we will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation.
      To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.
      Consequences of revocation
      If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
      You have the goods immediately and in any event not later than fourteen days from the day on which you inform us of the cancellation of this contract, to us or to (here may be the name and address of the person authorized by you to accept the goods insert) to be returned or handed over. The deadline is met if you send back the goods before the period of fourteen days has expired.
      You bear the direct costs of returning the goods.
      You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
  5. Product Information
    1. Usage: Our products are works of art (photo art) for hanging and viewing, designed solely for this purpose. Improper use can lead to damage and possibly also to injuries. We therefore strongly advise against using the products for any purpose other than that for which they were designed.
    2. Our works of art are usually delivered with integrated devices for hanging the pictures (e.g. hooks or rails). Please ensure that the pictures are firmly attached to the wall and hung out of the reach of small children.
  6. Prices and shipping costs
    1. The prices stated on the product pages include statutory VAT and other price components.
    2. In addition to the stated prices, we charge shipping costs for the delivery. The shipping costs depend on the size of the artwork and the destination country of the order. The shipping costs incurred for your order will be displayed to you before you place your order via Amazon (on the product pages, in the shopping cart system, on the order page). Depending on the country of delivery, you may incur additional customs duties and import sales tax for non-EU countries.
  7. Delivery
    1. The works of art are shipped in art security packaging by freight forwarders. Delivery will be made to the delivery address you have specified. Unfortunately, delivery to packing stations is not possible.
    2. We deliver to all countries of the European Union, as well as Great Britain, Switzerland, Norway, USA, Canada, Japan, Australia, New Zealand, Israel, UAE and Singapore.
    3. The delivery date of your ordered artwork depends on the production time and the delivery time. The delivery time depends in particular on the destination country of the order. The resulting delivery time for your order will be shown to you before you place your order via Amazon. For deliveries within the EU and within Europe, the delivery time is usually less than one month.
    4. Please check your delivery in the presence of the deliverer. If you notice any damage, please refuse acceptance. Please contact our customer service immediately afterwards so that they can order a replacement as quickly as possible. For a speedy processing it is helpful to send our customer service photos to document the damage by e-mail.

  8. Payment
    1. Your order is paid for via the “Nepomuk Rothbaum product pages” on Amazon. The ordered works of art are paid for by invoice.
    2. The amount of the deposit when ordering is 35% of the total invoice amount (including VAT and delivery costs), the remaining amount of 65% of the total invoice amount must be paid within 14 days of receipt of the artwork.
    3. After placing your order, you will receive an order confirmation and the invoice by e-mail. We will give you our bank details on the invoice.
    4. The production of the work of art will only take place after receipt of the deposit of 35% of the total invoice amount.
  9. Retention of Title
    The goods remain our property (Pauseback Media) until the total purchase price has been paid in full.
  10. Dispute Resolution
    The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a point of contact for the out-of-court settlement of disputes relating to contractual obligations arising from online sales contracts.
